These Terms & Conditions govern the use of the MandalaMind website and the purchase and use of MandalaMind services, courses, workshops and digital products.

MandalaMind is operated by Nicole Koch, Autónomo, in Spain.

1. Services

MandalaMind offers:

  • Personal-development coaching;

  • Non-clinical Personal Development Counselling;

  • Live online courses;

  • Recorded online courses;

  • Digital downloads;

  • In-person workshops; and

  • Related educational and personal-development content.

The specific description, price, duration and conditions of each service or product will be provided before purchase.

2. Eligibility

Unless otherwise stated, MandalaMind services are intended for people aged 18 or over.

By purchasing a service, the customer confirms that the information provided during registration or checkout is accurate.

3. Personal Development Coaching and Counselling

MandalaMind provides non-clinical Personal Development Coaching and Counselling

These services are educational and developmental in nature.

They are not a substitute for medical, or clinical psychological care.

MandalaMind does not provide emergency or crisis intervention.

Participation in a MandalaMind program does not establish a doctor-patient, psychotherapist-patient or other clinical treatment relationship.

4. User responsibility

Participants are responsible for determining whether a MandalaMind service is appropriate for their personal circumstances.

Participants remain responsible for their own decisions, actions and well-being.

If a participant has a medical or psychological condition requiring professional care, they should consult an appropriately qualified healthcare professional.

5. Booking and purchasing

Before completing a purchase, the customer will be provided with relevant information concerning:

  • The service or product;

  • Price;

  • Applicable taxes;

  • Duration or access period, where applicable;

  • Payment method;

  • Cancellation and withdrawal conditions;

  • Delivery/access arrangements; and

  • Other material conditions applicable to the purchase.

By completing a purchase, the customer agrees to the applicable purchase terms.

6. Prices and payment

Prices will be displayed in euros unless otherwise stated.  

Applicable taxes will be identified during the purchase process where required by law.

Payments may be processed through third-party payment providers including:

  • Stripe; and

  • PayPal.

MandalaMind does not ordinarily receive or store complete payment-card details processed by these payment providers.

Customers may also be subject to the relevant payment provider's terms and privacy policy.

7. Digital downloads and digital content

Digital products may include downloadable documents, audio, video, exercises, workbooks and other educational materials.

Unless otherwise specified, purchased digital content is provided for the purchaser's personal, non-commercial use.

Customers must not:

  • Share paid access with others;

  • Redistribute downloaded materials;

  • Upload materials to public or file-sharing websites;

  • Resell or sublicense materials;

  • Reproduce substantial portions for commercial purposes; or

  • Make paid content publicly available.

8. Immediate delivery of digital content

Where a customer purchases digital content and requests immediate access before expiry of the applicable withdrawal period, the customer may be asked to:

1.      expressly consent to the digital content being supplied immediately; and

2.    acknowledge that, once supply begins, the statutory right of withdrawal may be lost where the legal requirements for that exception are satisfied.

The checkout process will contain the applicable acknowledgement before immediate access is provided.

Nothing in these Terms removes mandatory consumer rights.

9. Live online courses

Live courses may be delivered through Zoom or another specified online platform.

The customer is responsible for having:

  • A suitable internet connection;

  • An appropriate device;

  • Any required software;

  • A functioning email address; and

  • Any other technical requirements communicated before the course.

Zoom's own terms and privacy policy may also apply to use of its platform.

10. Course recordings

When a course is recorded, participants will be informed and they will have access to the course recording for a limited time.

MandalaMind will take reasonable steps to respect participant privacy.

11. In-person workshops

Workshop details, including location, date, time and duration, will be provided during booking.

Participants must follow reasonable safety and venue requirements.

12. Cancellations and rescheduling

Specific cancellation and rescheduling terms may apply to individual services, courses and workshops and will be communicated at the time of booking.

Where a customer cancels, any refund will be handled in accordance with the applicable cancellation policy and mandatory consumer law.

Where MandalaMind cancels an event or is unable to provide a purchased service, customers will be offered an appropriate remedy, such as rescheduling or refund, where required by the circumstances and applicable law.

Mandatory statutory consumer rights always take precedence over contractual cancellation provisions.

13. Statutory right of withdrawal

Consumers purchasing services or products online may have a statutory right of withdrawal under applicable consumer legislation.

The general withdrawal period for qualifying distance contracts is 14 days, subject to statutory exceptions.

Different rules may apply where:

  • A service is fully performed within the withdrawal period following the consumer's expressed request and legally required acknowledgement;

  • Digital content is supplied immediately following the consumer's express consent and acknowledgement of the loss of the withdrawal right;

  • The contract concerns a particular date or period for certain

  • services or events; or

  • Another statutory exception applies.

MandalaMind will provide the information and consent mechanisms required by applicable law.

Nothing in these Terms limits mandatory consumer rights.

14. Intellectual property

All of Mandala Mind course content, exercises, frameworks, text, audio, video, workbooks and other materials remain protected by intellectual-property rights. This includes tools and resources being shared through offering services.

The materials are for personal use only and may not be copied, shared, reproduced or used commercially without permission.

15. Confidentiality

MandalaMind will treat information shared during coaching and counselling sessions appropriately and respectfully.

However, confidentiality may be limited where disclosure is required by law or where a legal obligation permits or requires disclosure.

Participants should understand that online communications and technology cannot be guaranteed to be completely secure.

Personal-data processing is governed by the Privacy Policy.

16. Third-party platforms

MandalaMind may rely on third-party platforms including Squarespace, Stripe, PayPal, Google Analytics, Mailchimp and Zoom.

MandalaMind is not responsible for interruptions or failures caused solely by third-party platforms outside its reasonable control.

19. International customers

MandalaMind accepts customers internationally.

Customers are responsible for ensuring that they are legally permitted to purchase and participate in the relevant service in their country.

Some services, workshops or products may have geographic restrictions for legal, tax, regulatory or practical reasons.

Where a particular service is unavailable in a customer's jurisdiction, MandalaMind will communicate this as appropriate.

20. Privacy and cookies

Personal information is processed in accordance with the MandalaMind Privacy Policy.

Cookies and similar technologies are explained in the MandalaMind Cookies Policy.

21. Changes to these Terms

MandalaMind may update these Terms where reasonably necessary, including because of changes to services, technology or applicable law.

The Terms applicable to a particular purchase will be those presented to the customer at the time of purchase, subject to mandatory legal requirements.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.

23. Applicable law and jurisdiction

These Terms are governed by Spanish law.

Where the customer is a consumer, mandatory consumer-protection legislation applicable to that customer will apply.

Where legally permitted, disputes may be submitted to the competent courts in Spain.
